Terms of Service
1. Scope of Service and Agreement
These Terms of Service apply to DontFW Holdings LLC and any of its partners or subsidiaries that process payment information, deliver products, provide account access, or support customer operations.
By accessing, purchasing, or using our services, you agree to these Terms of Service in full. If you do not agree, you must not purchase or use our services.
2. Product Type and Eligibility
Our products include Tier access and related FiveM server benefits, features, permissions, or roles. You are responsible for ensuring your account and server standing remain eligible for access.
We may set, change, or remove eligibility requirements at any time to protect service integrity, security, and community standards.
Eligibility and Age Requirement
By using our services, you represent that you are at least 18 years old or have permission from a parent or legal guardian. If you are under 18, you may only use the services with supervision and consent.
Acceptable Use
You agree to comply with all server rules, community guidelines, and platform policies. These rules may be updated at any time. Violations may result in suspension or permanent revocation of access without refund.
Delivery of Services
Access to purchased products is typically delivered digitally through your account, Discord roles, or in-server permissions. Delivery is considered complete once the associated benefits are applied to your account or made available for use.
Access is considered delivered once roles, permissions, or account benefits are assigned or made available, regardless of whether the user actively utilizes them.
Delays may occur due to technical or operational reasons, but such delays do not entitle you to a refund.
Payment Processing
Payments may be processed by third-party providers. By completing a purchase, you also agree to the terms and policies of the applicable payment processor.
Privacy
Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.
3. One-Time Purchase and Lifetime Access Definition
Where a product is marketed or sold as a one-time purchase with lifetime access, "lifetime" means the life of operation of the specific service, server, product line, or feature offered by DontFW Holdings LLC.
Lifetime access is not a promise of access for your natural life, and it does not guarantee uninterrupted operation, permanent feature availability, or indefinite support if operations change or end.
Lifetime access only applies while: (a) the service remains active, (b) your account is in good standing, and (c) you continue to comply with all policies and community rules.
4. Service Changes, Migration, and Retirement
We may modify, replace, migrate, consolidate, rebrand, or retire any service, server, tier, or feature at any time for operational, technical, legal, security, or business reasons.
If services are retired, lifetime designations do not create an obligation to maintain legacy systems indefinitely or to provide cash refunds, unless explicitly required by applicable law.
At our sole discretion, we may offer alternative access, a replacement tier, partial service credit, or no replacement remedy depending on the specific situation.
5. Account Ownership, Sharing, and Transfer
Purchases and access rights are personal to the original approved account and are non-transferable, non-resellable, and non-assignable unless we provide written approval.
Account sharing, resale, leasing, sublicensing, or attempts to transfer paid benefits may result in immediate suspension or permanent revocation without refund.
6. Access, Suspension, and Revocation Rights
Access to any plan, tier, feature, or account benefit may be suspended, restricted, limited, or revoked at any time, for any reason, at our sole discretion, with or without notice.
This includes but is not limited to moderation actions, abuse prevention, platform risk controls, fraud review outcomes, operational changes, legal requests, or policy enforcement decisions.
7. Ban Policy and Loss of Benefits
If your account is banned from the server, removed from the community, or otherwise restricted due to rule violations or risk concerns, you are not entitled to refunds, credits, replacements, extensions, or compensation.
Server bans or account removals immediately terminate any expectation of continued access regardless of remaining time in a purchased period.
8. Downtime and Compensation Limits
Compensation may be considered only for verified downtime directly caused by DontFW Holdings LLC managed systems and only when we choose to offer compensation.
We do not provide compensation for third-party impacts, including game platform outages, hosting provider failures, payment processor interruptions, Discord outages, internet provider problems, user-side technical issues, or force majeure events.
Any compensation we provide is limited to service credit, extension time, or another remedy chosen by us, and does not include cash refunds unless we explicitly approve one.
9. No Refund Policy and Final Sales
All purchases are final. No returns, no cancellations, and no refunds once payment is submitted and accepted.
By completing checkout, you acknowledge and accept this no-refund policy for all plans, tiers, and related products.
By completing checkout, you confirm you have read and agreed to these Terms of Service, including the no-refund and recurring billing terms where applicable.
Subscriptions, Billing, and Cancellation
If you purchase a subscription or recurring service, you authorize us and our payment processors to automatically charge your selected payment method on a recurring basis until you cancel.
It is your responsibility to cancel your subscription before the next billing date. Failure to cancel prior to renewal will result in automatic charges.
Failure to cancel before renewal does not constitute unauthorized billing.
Cancellations may be made through your account settings or by contacting support, where applicable. Cancellation stops future billing but does not retroactively refund prior charges.
Missed Cancellations and Renewal Charges
You are responsible for managing your subscription and cancellation timing. Charges resulting from missed cancellations or renewal dates are considered valid if the subscription was active at the time of billing.
Refunds for renewal charges are not guaranteed and are issued solely at our discretion or where required by law.
10. Disputes, Chargebacks, and Financial Liability
If you initiate a dispute, reversal, or chargeback through your bank, card provider, or payment platform, you may be permanently blacklisted from DontFW Holdings LLC and all partners or subsidiaries.
If a dispute is decided in our favor, you may be held liable for all associated costs, including processor dispute fees, administrative handling costs, recovery expenses, and any applicable civil penalties where permitted by law.
We may submit relevant records, logs, account history, and delivery evidence to dispute processors or legal authorities when needed to defend claims.
Such records may include access and connection logs, session timestamps, and linked identifiers associated with service usage, including Discord IDs, FiveM identifiers, Twitch identifiers, Xbox identifiers, and IPv4 or IPv6 addresses, where available and lawfully processed.
11. Fraud, Abuse, and Enforcement
We reserve the right to investigate suspicious activity, deny service, cancel pending access, and report fraudulent behavior to payment processors, platforms, partners, and law enforcement when appropriate.
Attempts to bypass restrictions, evade bans, or access paid features without authorization may result in permanent account restrictions and additional enforcement measures.
12. Limitation of Liability
All services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, DontFW Holdings LLC and its partners or subsidiaries are not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages.
Where liability cannot be fully excluded, total liability is limited to the amount paid by you for the specific affected service in the thirty (30) days before the claim arose.
13. Indemnification
You agree to defend, indemnify, and hold harmless DontFW Holdings LLC, its partners, subsidiaries, staff, and affiliates from claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your misuse of services, policy violations, disputes caused by your conduct, or unauthorized account activity.
14. Changes to Terms
We may update these Terms of Service at any time. Updated terms become effective when published. Continued access, purchasing, or usage after changes constitutes acceptance of the revised terms.
Force Majeure
We are not responsible for failure or delay in performance due to events beyond our reasonable control, including but not limited to natural disasters, infrastructure failures, cyberattacks, or platform outages.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
15. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.
You agree that any legal action or proceeding shall be brought exclusively in the state or federal courts located within Virginia, and you consent to the personal jurisdiction and venue of such courts.
